Before you file
- You must own the rights, or be authorised to act for the owner. Being annoyed by material is not a copyright claim.
- Consider fair use. Quotation, criticism, commentary, teaching and parody may be lawful without permission. The law requires you to consider this in good faith before sending a notice.
- A false notice has a cost. Under §512(f), knowingly misrepresenting that material is infringing makes you liable for damages, including the costs and legal fees of the person whose material was removed, and of us.
- We will tell them who you are. If the person whose material is removed files a counter-notice, the law requires us to give them a copy — including your name and postal address.
What happens next
- You get a reference number immediately. Keep it.
- We check the notice against the elements §512(c)(3)(A) requires. An incomplete notice is not actionable, and we will tell you what is missing rather than silently doing nothing.
- If it is complete and we uphold it, we remove or disable the material, tell the person who posted it, give them your notice, and record a strike against their account.
- They may file a counter-notice. If they do, we pass it to you. Unless you tell us within 10 business days that you have filed a court action seeking to restrain them, we may restore the material.
- An account that accumulates 3 live strikes is terminated. See the repeat-infringer policy.
